- Attempt to hack, reverse engineer, or compromise our systems
Consequences of Violation
Violation of these obligations may result in immediate suspension or termination of your access to our services, forfeiture of paid fees, and potential legal action.

6. Liability and Warranties

DataWise provides its services "as is" and "as available" without warranties of any kind, either express or implied. We specifically disclaim:
- Any guarantees of specific career outcomes, job placements, or salary increases
- Warranties that course content will meet all your professional needs
- Guarantees of uninterrupted or error-free access to course materials
- Warranties regarding compatibility with all devices or browsers
Limitation of Liability
To the maximum extent permitted by law, DataWise shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from your inability to access or use our services
- Damages resulting from third-party content or links on our website
Our maximum aggregate liability shall not exceed the total amount paid by you to DataWise in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold DataWise harmless from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these terms, misuse of our services, or infringement of third-party rights.
7. Force Majeure
DataWise shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

- War, terrorism, civil unrest, or government actions
- Internet service provider failures or cyber attacks
- Labor strikes or disputes affecting our operations
8. Dispute Resolution and Governing Law
Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of Finland, excluding its conflicts of law principles.
Jurisdiction
You agree that any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Helsinki, Finland, and you consent to the jurisdiction of such courts.
Dispute Resolution
Before initiating any legal proceedings, you agree to first attempt to resolve disputes through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue legal remedies.
EU Online Dispute Resolution
For residents of the European Union, the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are willing to participate in alternative dispute resolution procedures where appropriate.
9. Entire Agreement and Severability
Entire Agreement
These Terms & Conditions, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and DataWise regarding your use of our services and supersede all prior agreements or understandings.
Severability
If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
No Waiver
Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of DataWise.
10. Assignment and Transfer
You may not assign, transfer, or delegate your rights or obligations under these terms without our prior written consent. DataWise may assign or transfer its rights and obligations under these terms at any time, including in connection with a merger, acquisition, or sale of assets.
11. Modifications to Terms
We reserve the right to modify these Terms & Conditions at any time. Material changes will be communicated through:

Your continued use of our services after changes are posted constitutes acceptance of the modified terms. If you do not agree with the changes, you must discontinue use of our services.
12. Survival of Terms
Upon termination or expiration of these terms, any provisions that by their nature should survive shall continue to apply, including but not limited to provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
